The present writ petition has been filed seeking adjustment of ad hoc dearness allowance while refixing the pay. The contention which has been raised by the counsel for the petitioners is that the relief is being granted to the other similarly situated employees, but the petitioners' case is not considered on the ground that there is no direction from the competent court of law to consider their claim for the said benefits.

Counsel for the petitioners states that in order to claim the said benefits, the petitioners have issued a legal notice dated 10.09.2018 (Annexure P-5) as well as representation dated 17.09.2018 (Annexure P-6) which are still pending consideration with the Department and the petitioners will be satisfied at this stage, in case a direction is issued to the respondents to decide their legal notice/representation within a time frame.
