Mr. Dalbir Singh, Advocate for the petitioners **** RITU BAHRI , J. (Oral) Petitioners who are the English Language Lab Instructors from 2014 to 2016 in the Higher Education Department Haryana are aggrieved of the act of the Government for payment on lecturer basis @ Rs.200/- per months and further no enhancement has been made, they are not being paid for Sundays, Gazetted Holidays and during exams and further relieve them in vacations.

Learned counsel states that in all other departments of Haryana, the regular Computer Lab Instructors having the same qualifications to that of petitioners, are getting the regular pay scale of Rs.9300-34000+3600 Grade Pay.

Learned counsel for the petitioners is relying upon judgment passed by this Court in a case of Anurag Chahal and others vs. State of Haryana and anr, decided on 05.05.2016 and subsequently, this judgment has been followed by this Court in CWP No. 19789-2015 titled as Ramjeet Gaurav Arora 2018.11.20 16:24 I attest to the accuracy and integrity of this document Chandigarh

CWP No. 29064 -2018 and others v. State of Haryana and another, decided on 11.11.2016 and CWP No. 7048-2016 titled as Subhash Nautiyal and anr. v. State of haryana and others, decided on 21.03.2018 Issue notice of motion.

On asking of the Court, Mr. Harish Rathee, Sr. DAG, Haryana accepts notice on behalf of the State. Learned counsel for the petitioner is directed to supply copy of the petition to the learned State counsel by today itself.

In view of the above factual position, this petition, at this stage is being disposed of without expressing any opinion on the merits of the case, by giving a direction to respondent No. 2 to decide the final notice dated 03.10.2018 (Annexure P-16) of the petitioners by passing a speaking order, in view of above mentioned judgments, within a period of four months from the date of receipt of certified copy of this order.
