*** Sudhir Mittal, J. (Oral) The petitioner alleges that first floor is being constructed by the owner on the existing shops without getting approval from the Municipal Corporation and without sanction of any building plans.
To support the contention, learned counsel for the petitioner has relied upon information sought under the Right to Information Act, 2005 (Annexure P-3) and reply thereto (Annexure P-4). A perusal of Annexure P-3 shows that no information was sought with regard to construction of first floor without approval/getting a building plan sanctioned and, thus, reliance upon the reply is misconceived. There is no evidence on record to show that the first floor is being constructed without obtaining any permission or without getting a building plan sanctioned. Thus, the petitioner does not deserve any relief. The writ petition has no merit and is dismissed.
