Learned counsel for the respondent-Board states that a conscious decision has been taken for charging interest only on the unpaid amount and in view thereof the petitioner who had already deposited the entire amount with a view to save the property from being resumed, is entitled to refund of Rs.3,44,354/- which shall be refunded to him within one week and possession of the flat shall also be handed-over to the petitioner within one week or so.
In this view of the matter, the writ petition is rendered infructuous.
Ordered accordingly.
