BHARDWAJ , J (ORAL) Challenge raised in the present writ petition is to impugned termination order dated 09.03.2022 passed by Senior Divisional Manager, Life Insurance Corporation of India as well as order dated 27.06.2022 passed by the Zonal Manager.
Preliminary objection had been raised by the respondents-LIC that Rule 7(4) of the Life Insurance Corporation of India Development Officers (Revision of Certain Terms and Conditions of Service) Rules 2009 (for short "2009 Rules") provides for a remedy by way of submitting a Memorial to the Chief Executive in respect of that matter where appeal has been rejected by the Zonal Manager. Rule 7(4) of 2009 Rules reads thus: "1 to 6.

7. Termination of Service in certain cases- (1) to (3) xxxx
(4) [A Development Officer whose appeal has been rejected by the Zonal Manager may submit a Memorial to the Chief Executive in respect of that matter]"

CWP No.20809-2022 Learned counsel representing the respondents submits that even though the expression used in the aforesaid Rule is "may", however, in the event of petitioner submitting appeal within a fortnight of receipt of certified copy of this order, the respondents shall pass a reasoned and speaking order thereon in a time bound manner expeditiously, preferably within a period of three months. In view of the above, present petition is disposed of as not pressed, at this stage with the liberty to the petitioner to file the Memorial within a period of 15 days of receipt of certified copy of this order whereupon a decision, in terms of the undertaking given by the respondents, shall be taken.
