RAJESH BHARDWAJ, J.(ORAL) Instant writ petition has been filed under Articles 226/227 of the Constitution of India praying for issuance of writ in the nature of mandamus directing the respondents not to demolish the shop as well as residential house, situated at Siwana Sohna, Tehsil Sohna, District Gurugram, Annexure P-2, as the petitioner is having best and undisputed title over the aforesaid property.
It has been contended by counsel for the petitioner that petitioner is the owner of the residential house and there is every apprehension that the same would be demolished. He submits that for redressal of his grievances, he has already filed representation, dated 03.08.2023, Annexure P-5, to respondent No.3, Deputy Commissioner, District Gurugram, but no action has been taken on the same. He also submits that the issue involved in this petition is already pending adjudication before Hon'ble Division Bench of this Court in CWP-PIL-682023. After hearing counsel for the parties and going through the facts and circumstances of the case, the present petition is disposed of with a direction to respondent No.3, i.e. Deputy Commissioner, District Gurugram, to decide the representation, dated 03.08.2023, Annexure P-5 expeditiously in accordance with law preferably within one month from the date of receipt of certified copy of this order.
