Mr. Sachin Gupta, Advocate for respondent No.3. JASWANT SINGH, J (ORAL) Plaintiff-appellant is in appeal directed against the order dated 24.7.2014 passed by the First Appellate Court/Addl. District Judge, Kurukshetra whereby his application under Order 39 Rules 1 & 2 CPC filed along with the appeal against the judgment and decree dated 29.3.2014 passed by learned Addl. Civil Judge (Sr. Divn.), Pehowa dismissing his suit for mandatory injunction, has been dismissed.

At the time of hearing today, learned counsel for the appellant submits that the present appeal has become infructuous as in the meanwhile, the appeal has since been decided by the first Appellate Court in favour of the appellant. Dismissed as infructuous.
