The present writ petition has been filed under Articles 226/227 of the Constitution of India seeking issuance of a writ of Mandamus for staying the operation of the ejectment order dated 19.06.2025 (Annexure P1) passed by respondent no.2-DDPO, Sangrur till the final disposal of the statutory appeal and stay application filed by the petitioner before the respondent no.1.

Learned counsel for the petitioner, who is appearing through Video Conferencing, submits that the petitioner had filed an appeal under Section 7(2) of the Punjab Village Common Lands (Regulation) Act, 1961 assailing the order dated 19.06.2025 passed by respondent no.2-D.D.P.O, Sangrur. The appeal was filed before the learned Joint Development Commissioner, Department of Rural Development and Panchayat. Along with the appeal, an application dated 04.08.2025 (Annexure P-3) was LUCKY 2026.07.03 08:51 I attest to the accuracy and authenticity of this order/judgement High Court chandigarh

CWP-19193-2026 -2also filed seeking grant of stay of the operation and implementation of the impugned order but the same has not been decided by the respondent no.1Joint Development Commissioner and submits that the acute prejudice has been caused to the petitioner and the limited prayer made in the present petition is that direction may be issued to respondent no.1-Joint Development Commissioner to decide the stay application in a stipulated time frame, in accordance with law.

Learned State counsel, on instructions from Ms. Manjit Kaur, L.A, Court of Joint Development Commissioner, submits that the main appeal of the petitioner is pending before the respondent no.1-Joint Development Commissioner and submits that the stay application (Annexure P-3), which has been filed, will be considered and decided by respondent no.1 within a period of one month from today. 4.

Learned counsel for the petitioner submits that in view of the statement made by learned State counsel, the present petition may be disposed of.

In view of the above, present petition is disposed of accordingly.
