**** HARNARESH SINGH GILL, J.(Oral) Through this petition, the petitioner seeks regular bail in case bearing FIR No.9 dated 17.12.2021, registered under Sections 21(c), 23, 29, 61 and 85 of the NDPS Act; Sections 489-A, 489-B and 489-C IPC and Sections 25 and 27 of the Arms Act, at Police Station SSOC Fazilka, District Fazilka.
Short affidavit dated 14.11.2022 of the Deputy Superintendent, Central Jail, Ferozepur, filed on behalf of the respondentState, in the Court, is taken on record. On 19.09.2022, learned counsel for the petitioner has restricted his prayer to grant interim bail to the petitioner, on medical ground.
Learned counsel for the petitioner submits that the petitioner is 80-year old person and having various ailments including heart diseases and that as per his instructions, Doctors have advised him to undergo a surgery.

CRM-M-42115-2022 (O&M) -2As per the medical status report dated 14.11.2022 of the Medical Officer, Central Jail, Ferozepur, the petitioner has been undergoing treatment from the Doctors of PGIMER Chandigarh and is further advised to undergo CABG (Coronary Artery Bypass Graft) by the Doctors of Guru Gobind Singh Medical College and Hospital, Faridkot. I have heard the learned counsel for the parties. Keeping in view the medical condition of the petitioner, as noticed above and without commenting upon the merits of the case, the present petition is disposed of with a direction to release the petitioner for a period of three months from the date of his release, on furnishing bail/surety bonds to the satisfaction of the learned Chief Judicial Magistrate/trial Court /Duty Magistrate concerned.
