(ORAL) Learned counsel for respondent No.5 states that in pursuance to the order dated 06.09.2016 he has deposited the costs of ` 10,000/- with the Punjab Legal Services Authority on 20.09.2016. He has produced the receipt in this regard and the same is taken on record. 2.

Reply on behalf of respondent No.5 filed in Court today is taken on record subject to all just exceptions.

Prayer in this writ petition filed under Articles 226/227 of the Constitution of India inter alia is for issuance of a writ in the nature of mandamus for declaring the action of respondents No.2 to 4 dated 01.04.2016 (Annexure P-4), whereby technical bid submitted by the petitioner has been disqualified, as illegal and violative of instructions prescribed in Part-A of the tender document pertaining to technical bids issued by respondent No.2.

After arguing for some time, learned counsel for the petitioner submitted that he may be allowed to withdraw this writ petition with liberty to the petitioner either to avail remedy of civil suit or to take recourse to any other remedy as available under law.

Dismissed as withdrawn.
