In the present petition, the prayer of the petitioner is that his qualifying service for computing the pensionary benefits has not been assessed as per the service record of the petitioner, due to which, the petitioner has not been given the entitled pensionary benefits. 2.

Vide order dated 11.10.2022, the respondents were directed to file a specific affidavit giving the details of the qualifying service of the petitioner.

In pursuance to the said order, an affidavit dated 11.12.2023 has been filed by Sh. Surender Singh, General Manager, Delhi stating that as per the calculation, the petitioner had 33 years of service in his credit and the required benefits have already been calculated on the basis of qualifying service of 33 years and 06 days and the same has already been released to the petitioner.

Learned counsel for the petitioner submits that he has no instructions from the petitioner as to whether the consequential benefits upon recalculation of qualifying service of the petitioner have been released to the petitioner or not.

Learned counsel for the respondents submits that in case the consequential benefits have not been released to the petitioner so far, the same will be released to him within a period of six weeks from date of certified copy of this order is received by the department. 6.

Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed, any further. 7.

Ordered accordingly.
