MANJARI NEHRU KAUL, J. (ORAL) CRM-50148-2023 This is an application for impleading the complainant-Navtej Singh as respondent No.2, in the present petition. Amended memo of parties is taken on record subject to all just exceptions.

Main case.

This is a petition under Section 482 of the Code of Criminal Procedure, 1973 for quashing of FIR No.83 dated 26.7.2011 registered under Sections 419, 420, 465, 468, 471, 120-B of the IPC and Section 12 of the Passports Act, 167 , registered at Police Station Dharamkot, District Moga and order dated 6.1.2021 passed by JMIC, Moga, whereby the petitioner has been declared proclaimed offender, alongwith all other consequential proceedings arising thereto. 2.

Learned counsel for the petitioner has restricted his prayer to the quashing of order dated 6.1.2021 passed by JMIC, BANITA CHUGH 2023.12.15 17:27 I attest to the accuracy and integrity of this document

CRM-M-38089 of 2019 -2Moga, whereby the petitioner has been declared proclaimed offender. A request has been made by the learned counsel for the petitioner that the petitioner is willing to appear and surrender before the trial Court and, therefore, he be protected till then. Learned counsel further submits that the trial Court be directed to expeditiously decide his bail application being moved by the petitioner on his surrender. 3.

In compliance to order dated 14.7.2023, a photocopy of the air tickets of the petitioner had been placed on record by way of CRM-50149-2023. As per the Air tickets, the petitioner is due to arrive at Indira Gandhi International airport at 11.25 P.M. on 15.12.2023 i.e. today.

In view of the submissions made by learned counsel representing the petitioner, the petition is disposed of with a direction to the petitioner to appear and surrender before the trial Court within seven days from today i.e. on or before 22.12.2023. Till then, no coercive steps shall be taken against the petitioner. The trial Court, on any application under Section 439 Cr.P.C., being moved, shall decide it expeditiously in accordance with law.

However, it is made clear that in case the petitioner fails to surrender before the Court below within the above stipulated time period, this order shall be of no avail to him thereafter.
