**** HARSIMRAN SINGH SETHI , J. (ORAL) Present writ petition has been filed seeking retiral benefits. As per the averments made in the writ petition, the petitioner jointed as a Clerk in December, 1980 and he got the voluntary retirement on 31.03.2018. After the voluntary retirement, only pension is being paid to the petitioner, but other retiral benefits such as leave encashment, gratuity, GP Fund have not been paid to the petitioner. Further there is no impediment in release of the said benefits.

Counsel for the petitioner states that for the relief claimed in the present writ petition, the petitioner has served a legal notice through counsel dated 18.07.2018 (Annexure P-3) and the petitioner will be satisfied in case a time bound direction is given to the respondents to decide the said legal notice.

CWP-29192-2018 -2Without expressing any opinion on the merits of the case and the entitlement of the petitioner, the present writ petition is disposed of with a direction to the competent authority to pass the appropriate orders on the legal notice dated 18.07.2018 (Annexure P-3) within a period of three months from the date of receipt of a certified copy of this order. In case it is found that the petitioner is entitled for the relief as claimed by him, the same shall also be released to him within a period of next three months. Further, the respondents-State shall also consider to grant of interest while passing the order on the legal notice. Present writ petition stands disposed of.
