The present appeal has been filed against the judgment and sentence order dated 22.09.2021, passed by the learned Judge Special Court, Barnala, whereby the appellant has been convicted and sentenced to undergo rigorous imprisonment for a period of ten years under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and to pay fine of Rs.1,00,000/- and in default of payment of fine to undergo further RI for one year.

Learned counsel for the appellant submits that during the pendency of the appeal, the appellant has unfortunately passed away. 3.

Learned State counsel, on instructions, has placed on record the report of SHO Police Station, Dhanaula affirming regard the death of Babbu Singh appellant in a road accident on 05.03.2023. 4.

In view of the above, the present appeal stands disposed of being abated.
