Petitioner is seeking the concession of bail under Section 439 of the Code of Criminal Procedure, 1973 in case FIR No.71 dated 17.06.2021 registered under Section 22 of the NDPS Act, registered at Police Station Arniwala, District Fazilka.

At the outset, learned State counsel, on instructions, has informed the Court that the trial is nearing conclusion as the prosecution evidence stands concluded and the case is now fixed for defence evidence. Learned State counsel has further submitted that the petitioner was apprehended along with huge recovery of 1400 tablets of Tramadol pursuant to a secret information.

In the aforementioned facts and circumstances, keeping in view the stage of the trial, no ground is made out to enlarge the petitioner on bail at this stage.

The instant petition stands dismissed.

However, it is made clear that anything observed hereinabove shall not be construed to be an expression of opinion on the merits of the case.
