Mr. Hritik Gupta, Advocate for the petitioner. ***** KIRTI SINGH, J.(Oral) This petition under Section 528 and 529 of BNSS, 2023 has been filed for issuance of directions to the learned Sub Divisional Magistrate, Ganaur, to conclude the proceedings expeditiously in time bound manner in the CHI No.181 of 2019 date of institution 07.08.2019 titled as State of Haryana Vs. Rajiv pending before the learned Sub Divisional Magistrate, Ganaur for 21.08.2024. 2.

Learned counsel for the petitioner inter alia submits that a case FIR No.306 dated 18.06.2018 under Sections 120-B, 34, 406, 420, 467, 468, 471 of IPC, at Police Station Ganaur was registered against the petitioner at the instance of complainant Chander Prkash Garg against the respondents No.2 and 3 namely Rajiv and Rajat respectively, both sons of Sh. Rameshwar Dass. The challan was filed by the investigating agency on 07.08.2019 and thereafter the case was adjourned to 08.01.2020 for arguments on framing of charges. He further submits that on 08.01.2020 an application under Section 340 read with Sections 195, 250 of Cr.P.C. was moved by the accused No.1. Another application under Section 239 of KAVITA NAIN 2024.08.09 14:07 I attest to the accuracy and integrity of this document order/judgment Cr.P.C. for discharge of the accused was also filed. Accordingly, case was

CRM-M-38696-2024 -2adjourned to 22.04.2020 for filing reply of the above applications. He submits that after an unexplained delay the charges have been framed on 04.03.2024 and out of total 17 prosecution witnesses, none has been examined till date. The trial in this case will take considerable time to conclude.
