(ORAL) In the present writ petition, the claim has been made by the petitioner that even though he was promoted two days prior to the date of retirement as Assistant and he joined the said post on the day when he was to superannuate. Still, the petitioner is being paid the pensionary benefits by computing the salary to the post of Clerk. In respect of the claim which has been made in the writ petition, the petitioner has filed a representation dated 31.07.2017 (Annexure P-4). As per the counsel for the petitioner, the said representation is still pending consideration with the respondent(s)-State and the petitioner will be satisfied if a time bound direction is given to the competent authority to pass appropriate orders on the said representation. CWP-29245-2018 -2Keeping in view the request made, without expressing any opinion upon the merits of the case, the present writ petition is disposed of with a direction to the competent authority to pass the appropriate orders in respect of the claim made by the petitioner in representation dated 31.07.2017 (Annexure P-4) within a period of three months from the date of receipt of a certified copy of this order. In case it is found that any monetary benefit is to be given to the petitioner, the same shall be given to him within a period of next three months.
