At the very outset, learned counsel for the petitioner submits that after passing of the previous order dated 16.08.2023, by this Court, Trial Court has decided the application under Order 9 Rule 13 CPC, moved by the petitioner herein (JD) for setting aside ex-parte award dated 22.01.2020 (Annexure P-2) and also order dated 29.09.2017 (Annexure P-1), and has set aside the ex-parte proceedings.

Thus, learned counsel submits that the issue raised in the present revision petition has been redressed, therefore, present revision petition has been rendered infructuous and may be disposed of as such. 3.
