RAJESH BHARDWAJ, J.(ORAL) Instant writ petition has been filed under Article 226/227 of the Constitution of India praying for issuance of a writ in the nature of certiorari for quashing of order dated 10.03.2023, Annexure P-16, passed by respondent No.3 without hearing the petitioners alongwith ex parte report of respondent No.7/Tehsildar, dated 04.10.2021, Annexure P-4, and ex parte report of SDM/respondent No.6, dated 29.12.2021, Annexure P-5, and the same contrary to letter dated 28.06.2023, Annexure P-21, as well as letter dated 06.04.2023, Annexure P-20, alongwith consequential proceedings thereof, being without jurisdiction, wrong and illegal and contrary to the proceedings of civil suit pending in the Civil Court. At the outset, counsel for the petitioner submits that for redressal of his grievances he has already filed an appplication before the Financial Commissioner, Patiala Range, Patiala, dated 29.03.2023, Annexure P-18, however, no action has been taken on the same till date. After hearing counsel for the parties and going through the facts and circumstances of the case, the present petition is disposed of with liberty to the petitioners to pursue their remedy before respondent No.2, i.e. Financial Commissioner-cum-Secretary, who would decide their petition expeditiously in accordance with law.
