The present petition has been filed under Articles 226/227 of the Constitution of India seeking issuance of a writ in the nature of mandamus for directing the official respondents to protect the life, liberty and property of the petitioners which is in danger at the hands of respondent No.4 and for directing the official respondents not to buckle under the pressure of respondent No.4 and implicate the petitioners and their family members in any false and fabricated case.

Learned counsel for the petitioners submitted that the petitioners apprehend a threat to their life and liberty at the hands of respondent No.4, who is a Sub-Divisional Magistrate-cum-Returning Officer, Municipal Council, Khanna, District Ludhiana. In this regard, he referred to a letter dated CHETAN THAKUR 2026.06.17 19:59 I attest to the accuracy and authenticity of this order/judgment.
CRWP-7115-2026 -209.06.2026 (Annexure P-2) issued by the aforesaid officer to petitioner No.1, wherein it has been so stated that petitioner No.1 has given a false complaint and in case he does not tender an unconditional apology then she will be constrained to bring the matter to the notice of the Senior Superintendent of Police and take further action against him. He further submitted that the aforesaid letter is in the nature of a threatening letter and therefore, the life and liberty of the petitioners may be protected.

On the other hand, Mr. Vipin Pal Yadav, Addl. A.G., Punjab submitted that the present petition is baseless and on the basis of the aforesaid letter issued by the concerned officer as Annexure P-2, no such threat to the life and liberty of the petitioners can be made out and therefore, the prayer made in the present petition seeking protection of life and liberty is misconceived and totally false.

After hearing learned counsel for the parties and perusing the letter (Annexure P-2) stated to have been issued by respondent No.4, this Court is of the considered view that the contents of the letter do not suggest any threat to the life and liberty to the petitioners and the prayer in the present petition is only for seeking protection of life and liberty. 5.
