(Oral) Prayer in the present petition filed under Section 438 of the Code of Criminal Procedure, 1973 is for grant of anticipatory bail to the petitioner in case FIR No.79 dated 16.07.2019 under Sections 498-A, 406 IPC registered at Police Station Sadar Gurdaspur, District Gurdaspur. Parties are present in person. They have been interacted at sufficient length. The complainant says that she is ready to join the petitioner in a separate house where her mother-in-law is staying. At this stage, counsel for the petitioner, on instructions from the petitioner, says that the petitioner is staying in a separate house along with his mother and he will welcome the complainant in that house. Criminal Misc. No. M-35227 of 2019 -2the petitioner has also filed a petition under Section 9 of the Hindu Marriage Act, 1955 for restitution of his conjugal rights. Since the parties are ad idem to stay together, the complainant is directed to join the petitioner in her matrimonial home where her motherin-law is staying. They are expected to maintain cordial relations. Accordingly, the present petition is allowed and the interim order dated 28.08.2019 is made absolute.
