Prayer in the instant petition filed under Article 226 of the Constitution of India, is for issuance of directions to official respondents No.1 to 5 to provide protection of life and liberty to the petitioner and his family from respondent No.6.
It is the case of the petitioner that he was indulged in the business of online stock trading. He became friendly with respondent No.6 but due to aggressive behaviour of respondent No.6, an alercation took place between them on 05.06.2025 wherein respondent No.6 threatened the petitioner not to spare him. On 08.06.2025, when the petitioner was present at his rented house in DLF Phase 2, respondent No.6 along with 8-10 unknown persons came in two vehicles with an intention to assault the petitioner. The petitioner was beaten up badly by them with fists and weapons causing multiple injuries. In this regard, the petitioner filed two/three complaints and got registered two FIRs bearing No.0115 dated 11.06.2025, under Sections 115, 190, 191(3), 333 and 351(3) of BNS, 2023 and FIR No.0151 dated 12.06.2025 was registered at PS DLF, Phase-I, JYOTI 2025.07.04 18:19 I attest to the accuracy and integrity of this document
CRWP-7086-2025 Gurgram, under Sections 115, 190, 191(2), 324(4), 333 and 351 BNS, 2023. Immediately upon registration of said FIRs, the petitioner was threatened by respondent No.6 either to withdraw the cases or to face dire consequences. Learned counsel for the petitioner has contended that no action has been taken against respondent No.6 in the aforesaid FIRs by the Police. Respondent No.6 is a very influential person who had been continuously extending threats to the petitioner and his family. It is further submitted that the petitioner had filed various representations including the representation dated 20.06.2025 (Annexure P6) before respondent No.5, but till date no action has been taken.
During the course of arguments, learned counsel for the petitioner has stated that the petitioners would be satisfied, in case, the pending representation dated 20.06.2025 (Annexure P-6) is decided by respondent No.3.
Notice of motion.
Mr. Arjun Lakhanpal, Addl. A.G. Haryana, accepts notice and submitted that he has no objection if the aforesaid representation dated 20.06.2025 (Annexure P-6) is decided.
In view of the above, the petition is disposed of with a direction to respondent No.3-the DCP East, Gurugram, to look into the representation dated 20.06.2025 (Annexure P-6), at the earliest and to take necessary steps, if any required, in accordance with law. Disposed of.
