Prayer in this petition is for grant of interim bail to the petitioner in case arising out of FIR No. 311 dated 18.10.2025, registered under Sections 109, 132, 221, 253 and 3(5) of BNS, 2023 and Sections 25 and 27 of the Arms Act at Police Station Civil Lines Batala, District Batala. 2.

Learned counsel for the petitioner submits that the petitioner has been arraigned as an accused in the aforesaid case and is lodged in Central Jail, Gurdaspur since long. His mother has been diagnosed with breast cancer and is seriously ill. The father of the petitioner is also not keeping good health and is unable to take care of his wife. It is further submitted that since there is no active male member in the family, the petitioner is required to take care of his mother and get proper medical treatment for this terminal disease. Hence, it is urged that the petitioner may be granted concession of interim bail for a period of eight weeks for the said purpose.

Learned State counsel, on the basis of the instructions received from the SHO of the Police Station concerned, has not disputed the aforesaid fact but has expressed apprehension of the petitioner's absconding or committing similar offences, if extended benefit of interim bail. 4.

This Court has heard the rival submissions.

Since the mother of the petitioner has been diagnosed with a serious disease and needs proper medical as well as personal care, this Court finds it appropriate to release the petitioner on interim bail so that he can take care of his mother. Accordingly, the present petition is disposed of. The petitioner is ordered to be released from custody on interim bail w.e.f. 03.07.2026 till 03.08.2026, subject to his furnishing personal/surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned.
