AARADHNA SAWHNEY , J (ORAL) By virtue of filing instant petition, petitioner has invoked jurisdiction of this Court under Article 226 of the Constitution seeking a writ of Habeas Corpus for release of detenue Shivani (wife of the petitioner) and daughter of Late Mahender Singh from the illegal detention/custody of respondent No.5. In compliance of order dated 12.06.2026, Warrant Officer submitted his report dated 15.06.2026. As per which, he along with the petitioner, certain other family members and a lady police official raided the house of respondent No.5 at Village Ranipur, District Yamuna Nagar where Shivani (detenue) was found present there. She was taken to the Police Post, Ranjitpur where her statement was recorded.
In her statement, she stated that she had solemnized marriage with Ashish Kumar i.e present petitioner on 05.02.2022 but due to temperamental differences, her relations with her husband were not cordial. According to her, she left the matrimonial home in March 2026 and thereafter started residing with her parents at Village Roola Herdi. She stated that she is presently in live-in relationship with respondent No.5-Sumit Gujjar and that she MANOJ KUMAR 2026.06.
CRWP-7068-2026 wants her marriage with petitioner legally dissolved. She also expressed her desire to solemnize marriage with respondent No.5. In the wake of contents of said report as well as statement made by the detenue, it is evident that the petitioner's wife, who is major, left the matrimonial home of her own accord and is residing with respondent No.5 out of her own free will. There is nothing on record to suggest that she is under any illegal detention or unlawful confinement.
