*** HARSIMRAN SINGH SETHI , J. (ORAL) In the present writ petition, the claim of the petitioner is for the release of the retiral benefits in respect of the service which he had rendered from 05.08.1983 till the date of his retirement i.e. 28.02.2019. Counsel for the petitioner argues that petitioner retired from the Municipal Council, Ferozepur after his service has already been transferred and absorbed there. Counsel further argues that there is no impediment in the release of the pensionary benefits as there is no proceeding pending against the petitioner, which would entitle the respondents to withhold the same.
Counsel for the petitioner states that for the relief which has been sought in the present writ petition, petitioner has served the respondents with a legal notice dated 07.07.2019 (Annexure P-7), which is still pending consideration with the respondents and the petitioner will NARESH KUMAR 2019.09.04 13:11 I attest to the accuracy and integrity of this document Chandigarh
CWP-23313-2019 -2be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice by passing an appropriate speaking order.
In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 07.07.2019 (Annexure P-7) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of three months thereafter.
Present writ petition stands disposed of.
