FAO-4820-2015 This is claimant's appeal for enhancement of compensation in a death case.
Learned counsel for the appellant has contended that the appellants are satisfied with the compensation granted under various heads, however, no compensation for transportation of the deceased, as injured from Kurukshetra to Chandigarh and then PGI and then transporting his dead body SATYAWAN 2015.07.30 10:29 I attest to the accuracy and authenticity of this document High Court Chandigarh
FAO-1661-2015 -2from Chandigarh to Kurukshetra, has been awarded. Notice of motion to the Insurance Company only. Ms. Vandana Malhotra, Advocate accepts notice on behalf of the Insurance Company.
The distance from Kurukshetra to Chandigarh is 100 kilometers, therefore, without going further into the controversy as the dead body of the deceased was also taken back from Chandigarh to Kurukshetra, therefore, the total two way distance comes to 200 kilometer. Thus, an amount of ` 8 per kilometer is allowed to the claimants i.e. Rs. 1600/- for transportation of the injured from Kurukshetra to Chandigarh and then his dead body from Chandigarh to Kurukshetra. Therefore, the compensation of `1600/- over and above the compensation already granted by the Tribunal is awarded to the claimants.
Appeal is accordingly disposed of.
