Learned counsel for the petitioner submits that an ex parte eviction order dated 31.03.2017 was passed against the petitioner'spredecessor in-interest who died on 16.01.2022. The petitioner was not aware of the passing of the aforesaid order and as and when he came to know of the same, he filed an application under Order 9 Rule 13 CPC for setting aside of the afore referred ex parte eviction order which application is wrongly not being entertained by the Assistant Collector, First Grade, Samalkha, District Panipat (for short A.C).

Learned State counsel, on instructions, submits that if the petitioner, within one week from today files a hard copy of the afore referred application under Order 9 Rule 13 CPC before the A.C, the same would be entertained and an appropriate order thereupon shall be passed expeditiously, in accordance with law.
