***** PANKAJ JAIN, J. (ORAL) The petitioner herein has approached this Court by filing the present petition under Section 438 Cr.P.C.
The petitioner is facing trial pursuant to FIR No.74 dated 22.09.2016, for offences punishable under Sections 399 and 402 of the Indian Penal Code, 1860, read with Section 25/27 of the Arms Act, 1959. Admittedly the petitioner was admitted to regular bail on 13.01.2017. Thereafter, the petitioner has been regularly appearing before the learned trial Court. However, on 30.09.2021, the petitioner could not appear before the learned trial Court as he has noted wrong date. As per learned counsel for the petitioner, this is the first default by the petitioner. Learned State counsel has not controverted the said fact. CRM-M-45729-2021 -2In view of the facts and circumstances of the case, I deem it appropriate to direct the petitioner to surrender before the learned trial Court within seven days from the receipt of certified copy of this order. On doing so, the learned trial Court shall release the petitioner on furnishing fresh surety/bail bonds to its satisfaction. Disposed of.
