SUVIR SEHGAL, J. (Oral) The Court has been convened through video conferencing due to Covid-19 pandemic.

Through the instant petition, the petitioner seeks anticipatory bail in case FIR No.198 dated 12.10.2020 registered under Sections 22 and 29 of Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Boha, District Mansa.

On 17.12.2020, this Court passed the following order:- "The Court has been convened through video conferencing due to Covid-19 pandemic.

{2} State has sought more time to file status report in compliance of order dated 09.12.2020.

Counsel for the petitioner has argued that no recovery was effected from the petitioner. According to the counsel, recovery of contraband was made from one Preet Kaur, who named coaccused Jagdish Singh @ Godha and it was on the disclosure of Jagdish @ Godha, the petitioner was arraigned as an accused. Counsel has referred to the orders, Annexure P-2, whereby Jagdish Singh has been granted anticipatory bail by the Special Court, Mansa.

List on 24.03.2021.

Meanwhile, the petitioner shall join the investigation and would come present as and when called for and in the event of arrest, the petitioner shall be admitted to interim bail on his furnishing personal and surety bonds to the satisfaction of Arresting Investigating Officer. The petitioner shall also abide by the conditions as specified under Section 438(2) Cr.P.C." Status report filed by the State was taken on record, vide order dated 24.03.2021 passed by this Court.

Learned State counsel, on instructions from SI Rajinder Singh submits that the petitioner has joined investigation and is no longer required for custodial interrogation. He has further instructions to submit that no other case is pending against the petitioner.

{3} In view of the above facts, but without commenting on the merits of the case, the present petition is allowed and the order dated 17.12.2020 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
