(ORAL) Present petition has been filed u/s 482 Cr.P.C. seeking quashing of order dated 25th of July, 2023 whereby the investigation in FIR No.0041 dated 25th of May, 2018 stands tinkered with by adding provisions qua offences punishable under the SC & ST Act.

In the considered opinion of this Court since at the root lies the alleged illegality/illegal orders passed by the National Commission for Schedule Caste that too orally, the remedy of the petitioner would be to invoke Article 226 of the Constitution of India. Faced with the situation, counsel for the petitioner prays for withdrawal of the present petition with liberty to avail the afore-stated alternate remedy.

Ordered accordingly.

The petition is dismissed as withdrawn with liberty as prayed for.
