Renu Gupta v. State Of Haryana And ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CWP-23219-2019 (O&M) Date of Decision: May 18, 2022 RENU GUPTA
STATE OF HARYANA AND OTHERS CORAM:- HON'BLE MRS.JUSTICE LISA GILL
Present:
Mr. Vivek Khatri, Advocate for the petitioner. Mr. Sandeep Singh Mann, Addl.AG, Haryana.
*** LISA GILL, J.
Petitioner is an Extension Lecturer stated to be fulfilling all eligibility qualifications including having secured NET and working at Ch. Bansi Lal, Government College. Prayer in this writ petition is for quashing of order dated 19.08.2019 to the extent of respondent No. 4 being deputed to GCW, Tosham for a period of four months.
Notice of motion was issued in this writ petition on 29.08.2019 while noting contentions on behalf of the petitioner, which are as under:- "
Inter-alia contends that respondent No.4-Mahender Pal, vide order dated 19.08.2019, has been transferred from GC Bahadurgarh to GCW Tosham where the petitioner is already working as Extension Lecturer. Further contends that there is a workload and in the absence of the transfer policy, much less having worked from 26.03.2019, petitioner has been transferred." Interim protection was afforded to the petitioner. RITU SHARMA 2022.05.23 13:08 I attest to the accuracy and integrity of this document
CWP-23219-2019 (O&M) -2Writ petition has apparently been filed by the petitioner fearing her displacement on transfer of respondent No. 4. Though learned counsel for the petitioner during the course of hearing mentions that respondent No. 4 is also an Extension Lecturer, there is indeed no such averment in the writ petition neither is there anything on record to indicate the same. Reply in this case has not been filed till date. Be that as it may, it is to be noticed that respondent No. 4 was deputed to GCW, Tosham for a period of four months only. Clearly, said terms has come to an end in any case. Therefore, present writ petition is clearly rendered infructuous.
Accordingly, present petition is disposed of as infructuous. There is no expression of opinion on the merits of the matter. (LISA GILL) May 18, 2022 JUDGE rts
