(ORAL) The present petition has been filed under Article 226 of the Constitution of India inter alia seeking issuance of a writ in the nature of Mandamus for directing respondents No.2 and 3 to issue the passport of the petitioner which was applied by him vide application dated 29.03.2022 (Annexure P-1).

At the outset, learned counsel for the petitioner submits that the petitioner was arrayed as an accused in case FIR No.138 dated 26.12.2019 under Sections 323, 452, 427, 506, 148, 149, 379 and 325 of the Indian Penal Code, registered at Police Station Sadar Phagwara. 2.1 It is submitted that the petitioner has been declared innocent in the said case FIR and has not been challaned. 3.

application seeking issuance of passport, submitted by the petitioner, already stood closed way back in the year 2023 and as on date, there is no application of the petitioner, seeking issuance of the passport, pending with the passport authorities. She further submits that in case the petitioner has been declared innocent and/or the petitioner has not been challaned in the aforesaid case FIR, the petitioner can apply afresh for seeking issuance of passport with all the relevant documents and in the eventuality of his doing so, his application would be considered in accordance with law. 4.

Keeping in view the aforesaid stand taken by learned counsel for the respondents/Union of India, the present petition stands disposed of accordingly.
