***** ARCHANA PURI, J. (Oral) The present petition has been filed by the petitioner-Harmajot Kaur, for issuance of direction to respondents No.2 and 3 to hand over the investigation of FIR No.140 dated 04.10.2025 under Section 4 of Dowry Prohibition Act, to some independent agency like Crime Branch for fair investigation.
It is submitted by the counsel for the petitioner that the engagement of petitioner with the respondent No.4-Iqbal Singh, had taken place on 08.09.2022. On the basis thereof, the petitioner had established physical relationship with respondent No.4. But prior to the solemnization of marriage, respondent No.4-Iqbal Singh, had performed marriage with some other girl. It is further submitted that appropriate sections of BNSS Act, have not been complied with and therefore, fair investigation has not been conducted.
Counsel for the petitioner also submits that the representation dated 08.11.2025 (Annexure P-3), is still pending and no action has been taken upon the same.
On query by the court, learned State counsel submits that the said representation is pending. However, efforts were made to call upon respondent No.4-Iqbal Singh, to make appearance, but he had not made appearance. In view of the aforesaid disclosure, counsel for respondent No.4 submits that Iqbal Singh is employed in Indian Army and is presently posted in Assam. As per the instructions, the counsel submits that Iqbal Singh is ready to join the investigation and assist the court, for decision on the representation, within a period of six weeks from today onwards. In view of the undertaking given by the counsel for respondent No.4, counsel for the petitioner submits that the petitioner shall be satisfied if a direction is given to the Police Authorities to dispose of the pending representation, within a period of three weeks, after appearance of respondent No.4, before the Police Authorities.
Considering the submissions aforesaid, it is hereby ordered that respondent No.4-Iqbal Singh, as per the undertaking given by his counsel today, shall make appearance before the Police Authorities, within a period of six weeks from today onwards and upon his making appearance, the Police Authorities shall inform the complainant and call her to join the proceedings for the purposes of decision on the representation, which shall be decided by the Police Authorities, within a period of three weeks, after respondent No.4Iqbal Singh, makes appearance.
