AT CHANDIGARH CWP 29451/2018 Date of decision:05.12.2018 Gurpartap Singh ..............Petitioner v.

Guru Nanak Dev University and another ..............Respondents Coram:

Hon'ble Mr.Justice Jaswant Singh Present:- Mr.Vivek Sharma,Advocate for the petitioner Mr.Tejinderbir Singh,Advocate for the respondent. Jaswant Singh,J,(Oral).

The petitioner is stated to be working as a part time Lecturer on lecture basis in Guru Nanak Dev University College,Sujanpur, since July 2016.

Grievance is directed against the order dated 16.10.2018 (Annexure P2) passed by the Registrar, whereby his services have been terminated on the ground of findings of sexual harassment. It is contended that before passing of the termination order, no show cause along with the report was submitted, however, it cannot be disputed that keeping in view the fact that the petitioner had no right to hold the post, his services could be simpliciter terminated. At the time of resumed hearing today, counsel for the respondent has placed on record a copy of the order dated 3.12.2018 substituting the previous order and thereby dispensing with the services of the petitioner as part time Lecturer w.e.f. 15.10.2018.
