**** HARSIMRAN SINGH SETHI , J. (ORAL) Present writ petition has been filed with a prayer that the petitioner be granted the benefit of Assured Carrier Progression (ACP) as granted to a similarly situated person. Further, a grievance has been made that the payment which the department was to deposit in the GPF fund of the petitioner was not made from September, 1979 till April, 1999 and the same should be deposited along with interest. Further, the petitioner was not paid the salary for the period 13.08.1994 to 26.06.1995. During the course of the arguments, counsel for the petitioner admits that the petitioner has approached this Court with a delay as the petitioner had given a legal notice on 01.05.2007 (Annexure P-1) for the NARESH KUMAR 2018.11.29 10:38 I attest to the accuracy and integrity of this document Chandigarh

CWP-29471-2018 -2above-mentioned grouses but did not approach competent Court of law for redressal of his grievance. There is no explanation for the delay in approaching this Court.

Counsel for the petitioner states that the petitioner will not claim any arrears on account of any benefit in case, the same is granted by the respondents after deciding his representation/application dated 10.08.2018 (Annexure P-5).

In view of the above, the present writ petition is disposed of with a direction to the respondents to decide the legal notice/application dated 10.08.2018 (Annexure P-5) within a period of three months. It is made clear that this Court expresses no opinion on the merits of the case and entitlement of the petitioner for the relief claimed. Further, in case the respondents find any merit in the claim made by the petitioner, the same shall be granted notionally to him without any arrears. Present writ petition stands disposed of.
