Prayer in the present petition is for grant of anticipatory bail to the petitioner in a case FIR No.284 dated 31.05.2022 registered under Sections 354D, 509 and 34 IPC and Sections 66C/67 of IT Act at Police Station Narnaund District Hisar.

On 13.09.2022, this Court had passed the following order:- "Instant petition has been filed under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail in FIR No.284 dated 31.05.2022, registered for offences under Sections 354-D, 509, 34 of the Indian Penal Code, 1860 and 66-C, 67 of the Information and Technology Act, 2000, at Police Station Narnaund, District Hisar. Counsel for the petitioner contends that allegation against the petitioner, who is a young lady of 27 year old age, is that she has created fake Ids on social media sites and uploaded private photographs of the complainant, besides making telephone calls and sending messages in order to malign her reputation. Counsel urges that the

2023:PHHC:084352 Page 2 of 3 allegations are false. He submits that dispute between the parties has been settled and a compromise has been entered into. Counsel submits that the petitioner is ready to join the investigation and co-operate with the Investigating Agency.

Notice of motion.

On asking of the Court, Ms. Mahima Yashpal, DAG, Haryana accepts notice on behalf of the respondent-State. List on 24.01.2023.

Petitioner is directed to appear before the Investigating Officer at Police Station Narnaund, District Hisar on 19.09.2022 at 10.00 A.M. and join the investigation and appear as and when called by the Investigating Officer. In the event of arrest, she shall be admitted to interim bail on furnishing personal and surety bonds to the satisfaction of Arresting/Investigating Officer. She shall also abide by the conditions as specified under Section 438 (2) Cr.P.C."

Learned State Counsel, on instructions from Investigating Officer Vijay Tanvar states that in terms of the order passed by co-ordinate Bench of this Court, reproduced above, the petitioner has joined the investigation and no further interrogation is required at this stage.

In view of the above, the order dated 13.09.2022 granting interim bail to the petitioner is made absolute. However, the petitioner shall abide by following conditions:- i) He shall join the investigation as and when required by the Investigating Officer.

ii) He shall not offer any threat, promise or inducement to any person acquainted with the facts of the case so as to dissuade him from

2023:PHHC:084352 Page 3 of 3 disclosing the same to the Investigating Officer/Court; and iii) He shall not leave the limits of this country without prior permission of the Court.

In case at any given point of time hereinafter, it is felt by the investigating agency that the petitioner is required for the investigation but is not cooperating, they will be at liberty to approach this Court for passing appropriate orders.
