Prayer in the present petition filed under Section 482 Cr.P.C. is for issuance of direction to respondents No. 1 to 4 to transfer the enquiry of Complaint No. 194721-P.G.D. dated 06.07.2023 and Complaint No. 194958P.G.D, dated 07.07.2023 from respondent No. 4, i.e. the Commissioner of Police, Amritsar to any Gazetted Officer or any other District in the Range of respondent No.3, i.e. Deputy Inspector General of Police, Amritsar, except Amritsar as the local police is not inquiring the complaint properly. 2.

A short reply, dated 15.01.2024, by way of an affidavit of Sh. Rakesh Kumar, PPS, Assistant Commissioner of Police, Crime Against Women, Amritsar, along with inquiry report (Annexure R-1) is already on record.

Learned counsel for the State has pointed out that as per the aforesaid reply, a fair and impartial inquiry has been conducted qua the applications given by both the parties against each other and on the basis of Nitin 2024.04.23 17:05 I attest to the accuracy and integrity of this document

evidence produced by the respective parties, as well as on the basis of the evidence produced on behalf of the complainant Aashima Kesar, FIR No. 89, dated 01.10.2023, under Sections 406 and 498-A of the IPC, has been registered at Women Police Station, District Amritsar, against Anant Bhardwaj (son of the petitioner).

Learned counsel for the petitioner submits that the FIR was registered after the filing of the present petition. He prays that the present petition may be disposed of while granting liberty to the petitioner to avail alternate remedy.

Disposed of with the liberty aforesaid.
