SUDIP AHLUWALIA, J. (ORAL) The instant Petition has been filed under Section 439 of the Code of Criminal Procedure seeking Regular Bail on behalf of the Petitioner in case FIR No.197, dated 10th August, 2020, registered under Sections 148, 149, 323, 325, 452, 506, 379-B of the Indian Penal Code, at Police Station Chhachrauli, District Yamuna Nagar.

The Petitioner has remained in detention for more than 4 months since 13th August, 2020.

After completion of investigation, Challan against the Petitioner has already been submitted.

The prayer for bail is nevertheless opposed on behalf of the State by submitting that the Petitioner is a habitual offender and is involved in no less than 15 other cases apart from the present one. Ld. Counsel for the Petitioner however submits that his Client has already been acquitted in 9 out of those 15 cases and has only been convicted in FIR No.6 dated 9th January, 2015 of Police Station Bilaspur, so far.

Be that as it may, further detention of the Petitioner for an indefinite period is not called for as he is no longer required in the interest of investigation and on account of the on-going Covid-19 Pandemic there is little possibility of an expeditious completion of Trial. As such, the Petitioner is ordered to be released on bail to the satisfaction of the Ld. Trial Court/Duty Magistrate Concerned.
