Mr. Lupil Gupta, Advocate for the appellants. *** NIDHI GUPTA, J (Oral) The only ground on which the appellants assail the Award of the Ld. Tribunal is that the Tribunal has not taken into consideration the fact that deceased Kavita was a teacher in a school and was earning Rs.12,000/- per month. However, the learned counsel is unable to controvert the finding of the Tribunal in para 18 that "the petitioners have claimed that at the time of accident, the deceased Kavita was working as teacher in a school and earning Rs.12,000/- per month. The petitioners have not produced on record any witness of the school who can depose that Kavita was working in their school as a Teacher and earning Rs.12,000- per month. Even, no salary certificate of deceased Kavita was produced on record by the petitioner."
Perusal of the Award further shows that the Tribunal has correctly taken income of the deceased to be Rs.9000/- per month and applied multiplier of 18 as the deceased was 24 years old; besides this amount of Rs.15,000/- towards loss of estate, Rs.40,000/- towards consortium and Rs.15,000/- towards funeral expenses, has been awarded. Accordingly, total compensation of Rs.20,14,000/- has been awarded with interest @ 7.5% per annum. ASHOK KUMAR 2022.12.
FAO-2083-2021 No other contention has been raised by learned counsel for the appellant.
Accordingly, I find no reason to interfere in the Award given by the Tribunal.
Dismissed.
