Learned counsel for the petitioner submits that an application dated 03.08.2017 was moved before learned trial Court for sending second sample to the Forensic Science Laboratory but learned trial Court neither allowed nor dismissed that application till date. Notice of motion.

On asking of the Court, Mr. Arpinder Singh Sidhu, AAG Punjab, who is present in the Court, accepts notice. Without expressing any opinion on merits, this petition is disposed of with direction to learned trial Court to look into the factum of filing of application dated 03.08.2017 and if the same has not been disposed of till date, proceed further to dispose of the same at the earliest preferably within three months on receipt of copy of this order.
