The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 482 of the Code of Criminal Procedure, 1973), seeking issuance of appropriate directions to respondent Nos. 3 and 4 to take immediate and necessary legal action against private respondent Nos. 5 and 6, as cognizable offences under Sections 318(4), 316(2) and 61 of the Bharatiya Nyaya Sanhita, 2023 (corresponding to Sections 420, 406 and 120-B of the Indian Penal Code,
1860), as well as Section 66D of the Information Technology Act, 2000, are stated to be made out from Annexures P-1 and P-3, dated 10.05.2025 and 29.08.2025, respectively. The petitioner further seeks directions for conducting a fair, speedy and impartial inquiry/investigation under the supervision of a senior police officer not below the rank of Superintendent of Police, Moga, and for tracing, identifying and attaching the proceeds of the alleged fraud, including the monies lying in the accounts of respondent Nos. 5 and 6, in the interest of law, justice, equity and fair play. 2.
Learned counsel for the petitioner, inter alia, contends that the petitioner is an NRI and, on the basis of extensive publicity on social media platforms, he approached the private respondents for the purchase of a modified vehicle. Referring to paragraph No. 6 of the petition, she submits that complete particulars of the payments, duly supported by receipts and banking transactions, have been provided. It is further submitted that, after receiving a substantial amount for providing a modified Jonga vehicle, the private respondents neither delivered the vehicle nor returned the amount paid by the petitioner, despite their inducement and assurances. 2.1.
She further submits that a detailed representation (Annexure P-1) was submitted by the petitioner before respondent No. 3; however, no action has been taken thereon till date. Learned counsel for the petitioner submits that she would be satisfied if the representation (Annexure P-1) submitted by the petitioner is considered and decided by respondent No. 3
by passing a speaking order within a time-bound manner. 3.
Notice of motion to official respondents only. 4.
Mr. Bhanu Pratap Singh, Addl. AG, Punjab, puts in appearance and accepts notice on behalf of the respondent-State. 5.
Learned counsel for the State submits that he has no objection, in case a direction is issued to the respondent No.3 for time-bound consideration and decision of the representation (Annexure P-1) of the petitioner by passing a speaking order.

Therefore, in view of the limited prayer made by learned counsel for the petitioner, respondent No.3 is directed to consider the representation (Annexure P-1) of the petitioner and pass a speaking order, after affording an opportunity of hearing to the petitioner, within a period of two weeks from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by respondent No. 3.
