Naresh Kumar Sanghi, J.(Oral) Learned counsel contends that so far as Gurmukh Singh (since deceased) is concerned, it would be a case of composite negligence and as such, every wrong-doer is independently liable to satisfy the award passed by the learned Motor Accidents Claims Tribunal. However, he submits that learned Motor Accidents Claims Tribunal has failed to specify the inter se liability of the driver of the truck bearing registration No.HR-68-A-0381 and the driver of the car bearing registration No.PB-11-AP-0808, therefore, he prays for withdrawal of the present appeal with permission to file a civil suit before appropriate court for determination of the inter se liability of the drivers of two vehicles stated above.
