Learned counsel for the petitioner has submitted that the petitioner is in custody since 28.11.2025 and the investigation is completed and the challan has already been presented. It is further submitted that the petitioner is not involved in any other case. It is stated
-2that co-accused of the petitioner, namely, Gurjit Singh @ Happy, who was similarly placed as the petitioner, has applied for regular bail and the Co-ordinate Bench of this Court vide order dated 15.06.2026 passed in CRM-33273-2026 has granted the concession of regular bail. It is further submitted that a perusal of the FIR would show that the allegation with respect to pouring petrol on Inspector Jasvir Singh is attributed to only co-accused Sukhjinder Singh @ Seepa and there is no specific allegation against the petitioner.
3.
Learned State counsel, on the other hand, has submitted that the petitioner was the Vice-President of the Union and was also present there at the spot along with other persons. It is further submitted that the police officer Jasvir Singh had suffered five injuries . 4.
Learned counsel for the petitioner, in rebuttal, has submitted that the injuries suffered by the Inspector Jasvir Singh are simple in nature.
5.
This Court has heard the learned counsel for the parties and has perused the paper book.
6.
Keeping in view the above-said facts and circumstances, more so, the fact that the petitioner has been in custody since 28.11.2025 and the investigation is complete and the challan has already been presented and the fact that the petitioner is not involved in other case and also the fact that co-accused of the petitioner, namely, Gurjit Singh @ Happy, who is similarly placed as the petitioner, has already been granted the concession of regular bail by a Co-ordinate Bench of this Court vide order
-3dated 15.06.2026 passed in CRM-M-33273-2026 and the fact that injuries suffered by the Inspector Jasvir Singh are simple in nature, the present petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the concerned trial Court/ Duty Magistrate, subject to him not being required in any other case.
6.
However, it is made clear that in case, any act is done by the petitioner to threaten or influence the complainant or any of the witnesses, then it would be open to the State to move an application for cancellation of bail granted to the petitioner.
7.
Nothing stated above shall be construed as a final expression of opinion on the merits of the case and the trial would proceed independently of the observations made in the present case which are only for the purpose of adjudicating the present bail petition.
