**** HARSIMRAN SINGH SETHI , J. (ORAL) Counsel for the petitioner states that the petitioner retired from service on 28.02.2017. Despite the fact that more than one year and nine months has been elapsed, no payment has been made to the petitioner so far in respect of his retiral benefits. Further, the claim in the present case has been made for the release of the same along-with interest @ 9% per annum.

Counsel for the petitioner states that, at this stage, the petitioner will be satisfied in case a time bound direction is given to the respondents to decide his legal notice dated 13.10.2018 (Annexure P-4). CWP-29684-2018 -2the claim being made by the petitioner in the legal notice dated 13.10.2018 (Annexure P-4), the present petition is disposed of with a direction to the respondents to decide the claim made by the petitioner in the legal notice dated 13.10.2018 (Annexure P-4), by passing a speaking order, within a period of three months from the date of receipt of a certified copy of this order. In case, after the decision, it is found that the petitioner is entitled for any monetary benefits, the same should also be released to him within a period of three months thereafter. While passing the speaking order, the respondents will keep in mind the judgments of this Court passed in A.S. Randhawa Vs. State of Punjab and others, 1997(3) SCT 468 and J.S. Cheema Vs. State of Haryana reported as 2014(1) SCT 782 for the grant of interest on the delayed payment. Present writ petition stands disposed of accordingly.
