**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present case, the petitioner is praying for the relief of his pensionary benefits, which the respondents had withheld after he retired from service on 31.03.2015 and are not being released without any valid justification.

Counsel for the petitioner states that in the arbitration proceedings as well as in the vigilance inquiry, the petitioner has already been found innocent by the respondents themselves and therefore, now there is no justifiable reason with the respondents to withhold the pensionary benefits along with the other benefits including release of his house which has been attached by respondent No.3. Counsel for the petitioner furhter states that, at this stage, the petitioner will be satisfied in case a time bound direction is given to the respondents to decide the legal notice dated 23.09.2017 (Annexure P-9). CWP-29686-2018 -2Keeping in view the request made by counsel for the petitioner, without expressing any opinion on the merits of the case and the claim being made by the petitioner in the legal notice dated 23.09.2017 (Annexure P-9), the present petition is disposed of with a direction to the respondents to decide the claim made by the petitioner in the legal notice dated 23.09.2017 (Annexure P-9), by passing a speaking order, within a period of three months from the date of receipt of a certified copy of this order. In case, after the decision it is found that the petitioner is entitled for any monetary benefits or any other relief, as prayed in the legal notice, the same should also be given to him within a period of next three months.
