**** RAJ MOHAN SINGH, J. (Oral) Petitioner seeks anticipatory bail in case bearing FIR No.230 dated 05.08.2019 registered under Section 406 and 420 of Indian Penal Code and Section 120-B of Indian Penal Code was added subsequently by the police at Police Station Kosli, District Rewari.

Learned counsel for the petitioner states that the cheque issued by the petitioner in the context of some business transactions has been dishonoured for which no complaint has been filed by the complainant under Section 138 of Negotiable GEETA RANI 2020.01.27 18:30 I attest to the accuracy and integrity of this document

CRM-M No.35529 of 2019 -2Instruments Act nor any suit for recovery has been filed till date. Learned State counsel on instructions from SI Suresh Kumar states that petitioner has joined the investigation in pursuance of order dated 29.08.2019 and he is no more required in any further investigation of the case. Learned counsel for the complainant however opposed the prayer on the ground that an amount of Rs.83,00,000/- was advanced to the petitioner for which he has given a cheque on 25.06.2018. On presentation, the same has been dishonoured. The petitioner has an intention to misappropriate the amount and to cheat the complainant.

Since the petitioner has joined the investigation on 24.01.2020 and is no more required in any further investigation of the case, I direct that the order dated 29.08.2019 is made absolute, however petitioner shall abide by the conditions as envisaged under Section 438 (2) Cr.P.C.

Petition stands disposed of.
