**** RAJ MOHAN SINGH, J.(Oral) Petitioner seeks grant of regular bail in his second attempt under Section 439 Cr.P.C in case bearing FIR No.0221 dated 26.08.2019 registered under Sections 304-B, 498-A, 506 and 34 IPC, P.S. Israna City, Panipat, Tehsil Panipat, District Panipat. Earlier petition bearing CRM-M No.2484 of 2021 was dismissed on 25.01.2021.

As per allegations in the FIR, on 26.08.2019, Ravinder gave an information on the mobile that Kavita was serious. The complainant and his family members rushed to the house of the MOHMED ATIK 2022.04.02 14:23 I attest to the accuracy and integrity of this document

CRM-M-46209-2021  petitioner and found that Kavita was murdered by the accused by hanging her.

Evidently, Santosh (sister-in-law) and Sonu (brother-inlaw) have already been granted regular bail by this Court in CRM-M No.26098 of 2020 and CRM-M No.37410 of 2020 respectively.

Plea of alibi taken by the petitioner would be tested by the trial Court on the basis of quality of evidence to the led by the parties during trial. The earlier petition i.e. CRM-M No.2484 of 2021 was dismissed on merits. Admittedly, petitioner is husband of the deceased and the death has taken place within seven years of the marriage. Therefore, no indulgence can be granted in favour of the petitioner. The petition stands dismissed.
