This writ petition under Articles 226/227 of the Constitution of India has been filed for issuance of a writ in the nature of mandamus to the respondent for final disposal of ITA No.211 (Asr)/2007 within a fixed span of time. 2.
A prayer has been made for early hearing of the appeal fixed before the Tribunal. Nothing has been placed on record by the learned counsel for the petitioner to show that this is the oldest appeal which is pending before the Tribunal and that preference should be given thereto. Thus, we do not find any justification to order early hearing of the appeal. Consequently, the petition is dismissed.
