**** HARSIMRAN SINGH SETHI , J. (ORAL) Present writ petition has been filed seeking a direction to the respondents to release the pensionary benefits of the petitioner for which the petitioner is entitled for after his retirement from service on 31.05.2017.

Counsel for the petitioner states that except for the GPF, no further retiral benefits including the pension has been released to the petitioner. Further, even the GPF was released after a delay for which the petitioner is entitled for interest.

Counsel for the petitioner further states that, at this stage, the petitioner will be satisfied in case a time bound direction is given to the respondents to decide his representation (Annexure P-5) Keeping in view the request made by counsel for the petitioner, without expressing any opinion on the merits of the case and NARESH KUMAR 2018.12.03 15:25 I attest to the accuracy and integrity of this document Chandigarh

CWP-29724-2018 -2the claim being made by the petitioner in representation (Annexure P-5), the present petition is disposed of with a direction to the respondents to pass an appropriate speaking order, in respect of the claim of the petitioner for the release of his pensionary benefits along with interest made in representation (Annexure P-5), within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefits, the same should also be released to him within a period of three months thereafter. While passing the speaking order, the respondents shall keep in mind the judgment of this Court passed in A.S. Randhawa Vs. State of Punjab, 1997(3) SCT 468 for the grant of interest on the delayed payment.
