**** RITU BAHRI , J. (Oral) Petitioner is seeking direction to the respondents to absorb his services in the Department of Food and Drugs Control Administration, Government of Haryana at Palwal from Department of Health, Government Hospital, Palwal, District Palwal, in view of office letter dated 14.12.2010 (Annexure P-1) Petitioner is working on the post of Swasthay Sahayak in the Health Department since 1988 and is continuously working with Food Control Office in the Food Branch Palwal on the sanctioned post of Swasthay Sahayak. Despite the fact that there was sanctioned post of Swasthay Sahayak in the Food Control Office, the petitioner has not been absorbed in the Department of Food and Drugs Control Administration from the Health Department.
The petitioner has even given his option to absorb him in the Department of Food and Drugs Control Administration. In this regard, the petitioner has given representation dated 02.04.2012 (P3 ) but no action has been taken till date. Learned counsel has referred to letter dated 01.02.2018 (Annexure P-6) written by Civil Surgeon cum Designated Officer, Palwal to the Director General Health Services, Panchkula wherein it has been written that at the time of formation of Department of Food and Drugs Administration, all the employees working on the sanctioned posts related to Food and Drugs, have been absorbed/transferred in the Gaurav Arora 2019.01.
CWP No. 29729-2018 Department of Food and Drugs Administration but the present petitioner could not be absorbed due to some reason and it was requested that the petitioner be absorbed/transferred in the Department of Food and Drugs Administration. Without expressing any opinion on the merits of the case and keeping in view the fact that the matter of the petitioner is still in process, this petition is being disposed of by giving a direction to respondent Nos. 2 and 3 to pass speaking order on the letter dated 01.02.2018 (Annexure P-6) in accordance with law, within a period of six months from the date of receipt of certified copy of this order.
